Acceptance of terms

By downloading, installing, or using the CalQuestmobile application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App. These Terms apply to all users of the App.

License to use the App

Subject to these Terms, CalQuest grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, solely for your personal, non-commercial purposes.

You may not: copy, modify, or distribute the App; reverse-engineer or attempt to extract the source code; use the App in any way that violates applicable law; or sublicense the App to any third party.

User conduct

You agree not to:

• Use the App to upload, transmit, or store any content that is unlawful, harmful, or infringes on any third party’s rights.
• Attempt to gain unauthorized access to any portion of the App, its servers, or any connected systems.
• Use automated tools, bots, or scrapers to interact with the App without our prior written consent.
• Manipulate league scores, streaks, or any gamification elements through artificial means or exploits.
• Use the App in a way that could damage, disable, overburden, or impair our infrastructure.

We reserve the right to suspend or terminate your account if you violate these conduct rules.

Your content

You retain ownership of the content you submit to the App (food logs, photos, weight entries). By submitting content, you grant us a limited license to store, process, and display that content solely to provide the App’s features to you. We do not sell your personal content.

Disclaimers: “as is”

The App is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses.

Nutrition estimates generated by the App are AI-produced approximations and are not medical or dietary advice. Always consult a qualified health professional before making significant changes to your diet or exercise routine.

Limitation of liability

To the maximum extent permitted by applicable law, CalQuest and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of data, loss of goodwill, or loss of profits, arising out of or in connection with your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of these Terms or your use of the App shall not exceed the amount you paid us (if any) in the 12 months before the claim arose.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Continued use of the App after any update constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

Governing law

These Terms are governed by the laws of [your jurisdiction].Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.
